第一條為保證醫(yī)療臨床用血需要和安全,保障獻(xiàn)血者和用血者身體健康,發(fā)揚(yáng)人道主義精神,促進(jìn)社會(huì)主義物質(zhì)文明和精神文明建設(shè),制定本法。
Article 1 This Law is enacted with a view to ensuring the requirements and safety of blood for medical and clinical use, safeguarding the physical health of blood donors and blood users, promoting the humanitarian spirit and the building of socialist material civilization and spiritual civilization.
第二條國(guó)家實(shí)行無(wú)償獻(xiàn)血制度。
Article 2 The State practices the system of blood donation without compensation.
國(guó)家提倡十八周歲至五十五周歲的健康公民自愿獻(xiàn)血。
The State encourages voluntary blood donation by healthy citizens between ages 18 and 55.
第三條地方各級(jí)人民政府領(lǐng)導(dǎo)本行政區(qū)域內(nèi)的獻(xiàn)血工作,統(tǒng)一規(guī)劃并負(fù)責(zé)組織、協(xié)調(diào)有關(guān)部門(mén)共同做好獻(xiàn)血工作。
Article 3 Local people’s governments at all levels provide leadership for the blood donation work within their respective administrative areas, work out uniform planning and shall be responsible for the organization and coordination among the departments concerned in their joint efforts for the blood donation work.
第四條縣級(jí)以上各級(jí)人民政府衛(wèi)生行政部門(mén)監(jiān)督管理獻(xiàn)血工作。
Article 4 Departments of public health under local people’s governments at or above the county level shall supervise over and administer the blood donation work.
各級(jí)紅十字會(huì)依法參與、推動(dòng)獻(xiàn)血工作。
Red Cross Societies at all levels shall participate in and promote the blood donation work in accordance with law.
第五條各級(jí)人民政府采取措施廣泛宣傳獻(xiàn)血的意義,普及獻(xiàn)血的科學(xué)知識(shí),開(kāi)展預(yù)防和控制經(jīng)血液途徑傳播的疾病的教育。
Article 5 People’s governments at all levels shall take measures for the extensive publicity of the significance of blood donation and popularization of the scientific knowledge of blood donation and conduct education in the prevention and control or diseases spread via blood.
新聞媒介應(yīng)當(dāng)開(kāi)展獻(xiàn)血的社會(huì)公益性宣傳。
News media shall conduct nonprofit publicity about blood donation in society.
第六條國(guó)家機(jī)關(guān)、軍隊(duì)、社會(huì)團(tuán)體、企業(yè)事業(yè)組織、居民委員會(huì)、村民委員會(huì),應(yīng)當(dāng)動(dòng)員和組織本單位或者本居住區(qū)的適齡公民參加獻(xiàn)血。
Article 6 State organs, armed forces, social groups, enterprises, institutions, neighborhood committees and villagers’ committees shall motivate and organize citizens of their respective units or neighborhoods to take part in blood donation.
現(xiàn)役軍人獻(xiàn)血的動(dòng)員和組織辦法,由中國(guó)人民解放軍衛(wèi)生主管部門(mén)制定。
Measures for the motivation and organization for blood donation by active-duty service personnel shall be worked out by the competent department of health of the Chinese People’s Liberation Army.
對(duì)獻(xiàn)血者,發(fā)給國(guó)務(wù)院衛(wèi)生行政部門(mén)制作的無(wú)償獻(xiàn)血證書(shū),有關(guān)單位可以給予適當(dāng)補(bǔ)貼。
A certificate of blood donation without compensation produced by the department of public health under the State Council shall be issued to blood donors, and the units concerned may give appropriate allowances.
第七條國(guó)家鼓勵(lì)國(guó)家工作人員、現(xiàn)役軍人和高等學(xué)校在校學(xué)生率先獻(xiàn)血,為樹(shù)立社會(huì)新風(fēng)尚作表率。
Article 7 The State encourages state functionaries, active-duty service personnel and students in institutions of higher learning to take the lead in blood donation to set a role model in new social tendency.
第八條血站是采集、提供臨床用血的機(jī)構(gòu),是不以營(yíng)利為目的的公益性組織。
Article 8 Blood stations are institutions that collect and provide blood for clinical use and are nonprofit organizations not for the purpose of making profits.
設(shè)立血站向公民采集血液,必須經(jīng)國(guó)務(wù)院衛(wèi)生行政部門(mén)或者省、自治區(qū)、直轄市人民政府衛(wèi)生行政部門(mén)批準(zhǔn)。
Establishment of blood stations for the collection of blood from citizens shall be subject to the approval of the department of public health under the State Council or the departments of public health under the people’s governments of provinces, autonomous regions and municipal cities directly under the Central Government.
血站應(yīng)當(dāng)為獻(xiàn)血者提供各種安全、衛(wèi)生、便利的條件。
Blood stations should provide safe, hygienic and convenient conditions for the blood donors.
血站的設(shè)立條件和管理辦法由國(guó)務(wù)院衛(wèi)生行政部門(mén)制定。
Qualifications for the establishment of and measures for the management of blood stations shall be worked out by the department of public health under the State Council.
第九條血站對(duì)獻(xiàn)血者必須免費(fèi)進(jìn)行必要的健康檢查;
Article 9 Blood stations must conduct necessary physical checkup of blood donors free of charge.
身體狀況不符合獻(xiàn)血條件的,血站應(yīng)當(dāng)向其說(shuō)明情況,不得采集血液。
Blood stations shall explain the situation to those citizens whose health conditions do not conform to the qualifications for blood donation and must not collect blood from them.
獻(xiàn)血者的身體健康條件由國(guó)務(wù)院衛(wèi)生行政部門(mén)規(guī)定。
Physical health qualifications of blood donors shall be laid down by the department of public health under the State Council.
血站對(duì)獻(xiàn)血者每次采集血液量一般為二百毫升,最多不得超過(guò)四百毫升,兩次采集間隔期不少于六個(gè)月。
The amount of blood collected by a blood station from a blood donor at a time shall generally be 200 milliliters and must not exceed 400 milliliters at most, and the duration between two collections shall not be less than six months.
嚴(yán)格禁止血站違反前款規(guī)定對(duì)獻(xiàn)血者超量、頻繁采集血液。第十條血站采集血液必須嚴(yán)格遵守有關(guān)操作規(guī)程和制度,采血必須由具有采血資格的醫(yī)務(wù)人員進(jìn)行,一次性采血器材用后必須銷(xiāo)毀,確保獻(xiàn)血者的身體健康。
Article 10 Blood stations must strictly abide by relevant operational procedures and rules in blood collection, blood collection must be conducted by medical staff with qualifications for blood collection and disposable blood collection apparatuses must be destroyed after use to ensure the physical health of blood donors.
血站應(yīng)當(dāng)根據(jù)國(guó)務(wù)院衛(wèi)生行政部門(mén)制定的標(biāo)準(zhǔn),保證血液質(zhì)量。
Blood stations shall, in accordance with the standards formulated by the department of public health under the State Council, guarantee the quality of blood.
血站對(duì)采集的血液必須進(jìn)行檢測(cè);
Blood stations must conduct inspection and testing over the blood collected;
未經(jīng)檢測(cè)或者檢測(cè)不合格的血液,不得向醫(yī)療機(jī)構(gòu)提供。
blood without undergoing inspection and testing or failing to pass inspection and testing must not be provided to medical institutions.
第十一條無(wú)償獻(xiàn)血的血液必須用于臨床,不得買(mǎi)賣(mài)。
Article 11 Blood donated without compensation must be used for clinical purposes and must not be bought or sold.
血站、醫(yī)療機(jī)構(gòu)不得將無(wú)償獻(xiàn)血的血液出售給單采血漿站或者血液制品生產(chǎn)單位。
Blood stations and medical institutions must not sell the blood donated without compensation to stations of sole collection of plasma or production units of blood products.
第十二條臨床用血的包裝、儲(chǔ)存、運(yùn)輸,必須符合國(guó)家規(guī)定的衛(wèi)生標(biāo)準(zhǔn)和要求。
Article 12 Packaging, storage and transportation of blood for clinical use must conform to the hygienic standards and requirements prescribed by the state.
第十三條醫(yī)療機(jī)構(gòu)對(duì)臨床用血必須進(jìn)行核查,不得將不符合國(guó)家規(guī)定標(biāo)準(zhǔn)的血液用于臨床。
Article 13 Medical institutions must conduct verification over blood for clinical use and must not use blood not in conformity with standards prescribed by the state for clinical purposes.
第十四條公民臨床用血時(shí)只交付用于血液的采集、儲(chǔ)存、分離、檢驗(yàn)等費(fèi)用;
Article 14 A citizen shall only pay the expenses incurred in the collection, storage, separation and inspection of blood for the blood in clinical use;
具體收費(fèi)標(biāo)準(zhǔn)由國(guó)務(wù)院衛(wèi)生行政部門(mén)會(huì)同國(guó)務(wù)院價(jià)格主管部門(mén)制定。
specific rates shall be set by the department of public health under the State Council in conjunction with the department of price under the State Council.
無(wú)償獻(xiàn)血者臨床需要用血時(shí),免交前款規(guī)定的費(fèi)用;
In the event of clinical necessity of blood use by a blood donor without compensation, he or she shall be exempted from the expenses prescribed in the preceding paragraph;
無(wú)償獻(xiàn)血者的配偶和直系親屬臨床需要用血時(shí),可以按照省、自治區(qū)、直轄市人民政府的規(guī)定免交或者減交前款規(guī)定的費(fèi)用。
when the spouse and lineal relative of a blood donor without compensation requires blood in clinical use, exemption from or reduction of the expenses prescribed in the preceding paragraph may be effected in accordance with the provisions of the people’s governments of provinces, autonomous regions and municipalities directly under the Central Government.
第十五條為保障公民臨床急救用血的需要,國(guó)家提倡并指導(dǎo)擇期手術(shù)的患者自身儲(chǔ)血,動(dòng)員家庭、親友、所在單位以及社會(huì)互助獻(xiàn)血。
Article 15 To ensure the requirements for clinical emergency blood use by citizens, the State encourages and guides patients to be operated upon at a selected date in self blood storage and motivates his or her family, relatives and friends and the unit wherein he or she is employed as well as society for blood donation in mutual assistance.
為保證應(yīng)急用血,醫(yī)療機(jī)構(gòu)可以臨時(shí)采集血液,但應(yīng)當(dāng)依照本法規(guī)定,確保采血用血安全。
To guarantee emergency blood use, medical institutions may collect blood on a provisional basis; however, safety in blood collection and blood use shall be ensured in pursuance of the provisions of this Law.
第十六條醫(yī)療機(jī)構(gòu)臨床用血應(yīng)當(dāng)制定用血計(jì)劃,遵循合理、科學(xué)的原則,不得浪費(fèi)和濫用血液。
Article 16 Medical institutions shall work out blood use plans for clinical use following the rational and scientific principle and shall not waste and abuse blood.
醫(yī)療機(jī)構(gòu)應(yīng)當(dāng)積極推行按血液成份針對(duì)醫(yī)療實(shí)際需要輸血;
Medical institutions shall actively carry out blood transfusion in accordance with blood components in light of actual medical requirements.
具體管理辦法由國(guó)務(wù)院衛(wèi)生行政部門(mén)制定。
Specific control measures shall be worked out by the department of public health under the State Council.
國(guó)家鼓勵(lì)臨床用血新技術(shù)的研究和推廣。
The State encourages research and extension of new technologies in clinical blood use.
第十七條各級(jí)人民政府和紅十字會(huì)對(duì)積極參加獻(xiàn)血和在獻(xiàn)血工作中做出顯著成績(jī)的單位和個(gè)人,給予獎(jiǎng)勵(lì)。
Article 17 People’s governments and Red Cross Societies at all levels shall give rewards to units and individuals that take an active part in blood donation and make outstanding achievements in blood donation work.
第十八條有下列行為之一的,由縣級(jí)以上地方人民政府衛(wèi)生行政部門(mén)予以取締,沒(méi)收違法所得,可以并處十萬(wàn)元以下的罰款;構(gòu)成犯罪的,依法追究刑事責(zé)任:
Article 18 Whoever commits any of the following acts shall be banned by the department of public health under the people’s government at or above the county level, the illegal gains shall be confisticated and may be concurrently imposed a fine of less than RMB 100,000 Yuan; where a crime has been constituted, criminal liability shall be investigated according to law:
(一)非法采集血液的;
(1)illegal collection of blood;
(二)血站、醫(yī)療機(jī)構(gòu)出售無(wú)償獻(xiàn)血的血液的;
(2)sale of blood donated without compensation by blood stations and medical institutions; and
(三)非法組織他人出賣(mài)血液的。
(3)illegal organization of other persons in selling blood.
第十九條血站違反有關(guān)操作規(guī)程和制度采集血液,由縣級(jí)以上地方人民政府衛(wèi)生行政部門(mén)責(zé)令改正;
Article 19 A blood station that collects blood in contravention of the relevant operational procedures and rules shall be ordered by the department of public health under local people’s government at or above the county level to make a rectification;
給獻(xiàn)血者健康造成損害的,應(yīng)當(dāng)依法賠償,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員,依法給予行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。
where harm has been caused to the health of blood donors, compensation shall be paid according to law, the person-in-charge held directly responsible and other personnel directly responsible shall be imposed administrative sanctions; where a crime has been constituted, criminal liability shall be investigated according to law.
第二十條臨床用血的包裝、儲(chǔ)存、運(yùn)輸,不符合國(guó)家規(guī)定的衛(wèi)生標(biāo)準(zhǔn)和要求的,由縣級(jí)以上地方人民政府衛(wèi)生行政部門(mén)責(zé)令改正,給予警告,可以并處一萬(wàn)元以下的罰款。
Article 20 Anyone whose packaging, storage and transportation of blood for clinical use fail to meet hygienic standards and requirements prescribed by the state shall be ordered by the department of public health under the local people’s government at or above the county level to make a rectification, administered a warning and may concurrently be imposed a fine of less than RMB 10,000 Yuan.
第二十一條血站違反本法的規(guī)定,向醫(yī)療機(jī)構(gòu)提供不符合國(guó)家規(guī)定標(biāo)準(zhǔn)的血液的,由縣級(jí)以上人民政府衛(wèi)生行政部門(mén)責(zé)令改正;
Article 21 A blood station that supplies blood which fails to meet standards prescribed by the state to medical institutions in violation of the provisions of this Law shall be ordered by the department of public health under the people’s government at or above the county level to make a rectification;
情節(jié)嚴(yán)重,造成經(jīng)血液途徑傳播的疾病傳播或者有傳播嚴(yán)重危險(xiǎn)的,限期整頓,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員,依法給予行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。
where the circumstances are serious resulting in the spread of diseases via blood or having serious danger of spreading, consolidation shall be carried out within a specified time period, the person-in-charge held directly responsible and other personnel directly responsible shall be imposed administrative sanctions; where a crime has been constituted, criminal liability shall be investigated according to law.
第二十二條醫(yī)療機(jī)構(gòu)的醫(yī)務(wù)人員違反本法規(guī)定,將不符合國(guó)家規(guī)定標(biāo)準(zhǔn)的血液用于患者的,由縣級(jí)以上地方人民政府衛(wèi)生行政部門(mén)責(zé)令改正;
Article 22 Any medical practitioner of a medical institution who, in violation of the provisions of this Law, uses the blood which fails to meet the standards prescribed by the state on patients shall be ordered by the department of public health under local people’s government at or above the county level to make a rectification;
給患者健康造成損害的,應(yīng)當(dāng)依法賠償,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員,依法給予行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。
where harm has been caused to the health of patients, compensation shall be paid according to law, the person in-charge held directly responsible and other personnel directly responsible shall be imposed administrative sanctions; where a crime has been constituted, criminal liability shall be investigated according to law.
第二十三條衛(wèi)生行政部門(mén)及其工作人員在獻(xiàn)血、用血的監(jiān)督管理工作中,玩忽職守,造成嚴(yán)重后果,構(gòu)成犯罪的,依法追究刑事責(zé)任;尚不構(gòu)成犯罪的,依法給予行政處分。
Article 23 Any public health department and its staff that neglect their duties in the supervision and administration of blood donation and blood use causing serious consequences and constituting a crime shall be investigated of the criminal liability according to law; where a crime has not been constituted, administrative sanctions shall be imposed according to law.
第二十四條本法自1998年10月1日起施行。
Article 24 This Law shall enter into force as of October 1, 1998.
